Culture wars: Why gay marriage and abortion have been ?decoupled?

Public opinion on abortion has held constant for 30 years. But on gay marriage, acceptance has grown dramatically in just 10 years ? most notably among young evangelical Protestants.

The contrasting images on the news this week could not have been more stark: On the steps of the Supreme Court, supporters of gay marriage celebrated two victories ? and a new sense of momentum.

But in Texas, abortion rights were under siege in the state legislature, as Gov. Rick Perry (R) sought to join the wave of states imposing sweeping restrictions on the procedure. The effort failed, with a dramatic filibuster, but he?ll try again Monday.

What?s going on?

The ?values? issues that used to move in lock step in American opinion have been ?decoupled,? say experts on public attitudes. Public opinion on abortion has held remarkably constant in the last 30 years. But on gay marriage, acceptance has grown dramatically in just 10 years ? most notably among young evangelical Protestants.

?Gay rights and abortion were the heart of the culture war debate for years, and we talked about them synonymously,? says Daniel Cox, research director at the Public Religion Research Institute (PRRI) in Washington. ?That?s changing.?

For now, there?s little overlap between states that have legalized gay marriage or may get there in the next few years (all of them Democratic or battleground states) and states that are cracking down on abortion (most of them solidly Republican). These divergent social trends are producing a nation that is, more than ever, a cultural patchwork.

But that could change, at least on gay marriage, given the generational differences in opinion. A March poll by PRRI shows nearly a 40-point generation gap between Millennials (age 18 to 29) and seniors (65 and older) on the issue of same-sex marriage. Seventy-two percent of Millennials favor it, compared with 36 percent of seniors.

Even among white Millennial evangelical Protestants, a majority ? 52 percent -- support gay marriage. Among all white evangelicals, 24 percent favor the right to same-sex marriage. So on this issue, Mr. Cox points out, young white evangelical Protestants more closely resemble those in their age cohort than their coreligionists.

?It often comes down to personal experience,? says Cox. ?Young people are more likely to have friends or family who are gay or lesbian, and that has a profound impact on attitudes about that issue ? it trumps ideology and theology.?

Of course, Americans of all ages have grown more comfortable with homosexuality, as gays and lesbians have become more open about their identity, and about pressing for the same rights as heterosexual couples and families.

It?s no accident that conservatives with gay family members have been among the first prominent Republicans to endorse the right to same-sex marriage, such as former Vice President Dick Cheney and Sen. Rob Portman (R) of Ohio.

Societal experience with gay marriage in the 10 years since Massachusetts became the first state to legalize it has also helped build support.

?There was a traditional argument that the law had to defend marriage or terrible things would happen,? says John Green, director of the Ray C. Bliss Institute of Applied Politics at the University of Akron. ?Apparently, really terrible things haven?t happened.?

Hollywood has also helped, with sympathetic depictions of gay relationships and families that are now commonplace.

Defenders of traditional marriage say that gay relationships are unnatural ? or sinful, in the eyes of some ? and should not be granted societal sanction. Children need a mother and father, they say.

Tony Perkins, president of the Family Research Council in Washington, suggests it?s too soon to conclude that same-sex marriage won?t be harmful to society.

?As the American people are given time to experience the actual consequences of redefining marriage, the public debate and opposition to the redefinition of natural marriage will undoubtedly intensify,? Mr. Perkins says.

Time will tell. But there?s no doubt that it?s easier to argue the downside to abortion, which sets up a ?clash of absolutes,? as legal scholar Laurence Tribe puts it ? the woman?s rights versus the rights of the fetus, which grow as a pregnancy progresses.

?With abortion, there seems to be evident harm,? says Mr. Green. ?Even people who are prochoice and don?t believe life begins at conception recognize there?s a consequence to abortion.?

And so while it?s possible to foresee a day when gay marriage is largely uncontroversial, the same can?t be said for abortion. That element of the culture war appears to be here to stay.

Having previously been part of the wedding industry, I have seen the havoc certain wedding guests unwittingly create for soon-to-be-wed couples and their families. As wedding season is upon us, I hope addressing some of the common problems might help prevent them from actually?occurring.

Although most of us may host only one wedding in our lifetime, we generally will be invited to several. Maybe several in one year! So, what are the wedding guests? obligations? While the bride, groom, and each set of families have their roles, and responsibilities, so do the invitees. Here are some ?do?s and don?ts? for those who have received the honor of being?invited.

The Invitation: It will tell you a lot more than just who, what, where, and when. It will give you a deadline to make a decision, tell you what to wear, and even what you will be eating should you attend. Let?s start with the basics. Who is invited? Only the names of the people actually appearing on the outside envelope are being invited to attend. So, for example, if the envelope is addressed to Mr. and Mrs. John Smith, only the husband and wife are invited. This does not mean you can bring along your children. Similarly, if it reads Miss Cindy Jones without mentioning the words ?and guest? or ?and escort,? you do not invite, or bring along, a?date.

If you have ever planned a wedding or similar social event (bar/bat mitzvah, anniversary party, etc.) you realize that every person not only equates to a cost for the meal (ranging from $30-$75 typically) but is figured into chair and table rentals, often special seating arrangements, and ballroom accommodations. It is very inappropriate to add people you want to bring and, even worse, to show up with someone uninvited! A wedding is not a party to??crash.?

The Reply Card: Many people don?t really know what they are to do here with these pre-printed little cards. Allow me to clarify: The little ?M_______________? that is on the reply card is where you write in your name(s) as you were invited: ?Mr. and Mrs. John Smith.? If you are planning to attend, and if the card reads ?will________attend? on the following line you may leave it blank, or write ?gladly,? etc. If you are not attending, then write the word ?not? in the blank space. If one person will attend when more than one is invited, write in the name of the person attending only. You may write a simple note of explanation or clarification on the back of the card if you wish to explain about those not?coming.

Unless your children are invited, do not add them to the reply card. There will not be special food for them, nor will there be childcare, and the atmosphere will be for adults. The families hosting the affair have spent a lot of time and money creating their event; please don?t spoil their plans. The total number often asked for at the bottom of the reply card is not where you get to add your own extra family?members.

It is appreciated if you respond as soon as possible and not wait until the deadline given, which is the very last date before the hosts need to total their list and give a guarantee to the caterer. Sometimes the family may have more people they want to invite, but have space or budget limitations. So if you cannot attend and respond sooner versus later, they can then invite additional people on their list. A prompt response also helps in arranging rentals, flowers, and other important?details.

If you cannot come and you?ve already said you will, do call as soon as you know so adjustments can be made before their day arrives. Last-minute changes on the wedding day are more than a bride can often?handle!

El Nino unusually active in the late 20th century: Is it because of global warming?

June 30, 2013 ? Spawning droughts, floods, and other weather disturbances world-wide, the El Ni?o -- Southern Oscillation (ENSO) impacts the daily life of millions of people. During El Ni?o, Atlantic hurricane activity wanes and rainfall in Hawaii decreases while Pacific winter storms shift southward, elevating the risk of floods in California.

The ability to forecast how ENSO will respond to global warming thus matters greatly to society. Providing accurate predictions, though, is challenging because ENSO varies naturally over decades and centuries. Instrumental records are too short to determine whether any changes seen recently are simply natural or attributable to human-made greenhouse gases. Reconstructions of ENSO behavior are usually missing adequate records for the tropics where ENSO develops.

Help is now underway in the form of a tree-ring record reflecting ENSO activity over the past seven centuries. Tree-rings have been shown to be very good proxies for temperature and rainfall measurements. An international team of scientists spearheaded by Jinbao Li and Shang-Ping Xie, while working at the International Pacific Research Center, University of Hawaii at Manoa, has compiled 2,222 tree-ring chronologies of the past seven centuries from both the tropics and mid-latitudes in both hemispheres. Their work is published in the June 30, 2013 online issue of Nature Climate Change.

The inclusion of tropical tree-ring records enabled the team to generate an archive of ENSO activity of unprecedented accuracy, as attested by the close correspondence with records from equatorial Pacific corals and with an independent Northern Hemisphere temperature reconstruction that captures well-known teleconnection climate patterns.

These proxy records all indicate that ENSO was unusually active in the late 20th century compared to the past seven centuries, implying that this climate phenomenon is responding to ongoing global warming.

"In the year after a large tropical volcanic eruption, our record shows that the east-central tropical Pacific is unusually cool, followed by unusual warming one year later. Like greenhouse gases, volcanic aerosols perturb the Earth's radiation balance. This supports the idea that the unusually high ENSO activity in the late 20th century is a footprint of global warming," explains lead author Jinbao Li.

"Many climate models do not reflect the strong ENSO response to global warming that we found," says co-author Shang-Ping Xie, meteorology professor at the International Pacific Research Center, University of Hawaii at Manoa and Roger Revelle Professor at Scripps Institution of Oceanography, University of California at San Diego. "This suggests that many models underestimate the sensitivity to radiative perturbations in greenhouse gases. Our results now provide a guide to improve the accuracy of climate models and their projections of future ENSO activity. If this trend of increasing ENSO activity continues, we expect to see more weather extremes such as floods and droughts."

Where Have All The Dad's Departed To and What is the Cost ...

In a new study from the US Census Bureau, the percent of children born to unmarried women hit nearly 37 percent in the U. S., up from about 31 percent in 2005. The number of children living apart from their fathers has more than doubled in the last fifty years, from 11 percent in 1960 to 27 percent in 2010. According to the Pew Research Center analysis of the National Survey of Family Growth (NSFG), more than one-in-four fathers with children 18 or younger do not live with their child(ren).

With this statistic comes a myriad of problems afflicting individuals and communities alike. Single parenthood is a large predictor of poverty, simply because it costs less to raise a child in a two parent home. The cost of raising children under the age of eight for single parent families ranged from $12,450 to $14,250 with many on public assistance. The cost of raising a child in a two-family home is approximately half this cost.

dad1The absence of significant fatherhood involvement and engagement can have a profound effect on the quality and quantity of early experiences for a child that can affect lifelong disparities in health and wellness and impact community dollars. The brain architecture has been proven to be a foundation for overall learning, development, behavior, and health of a child. Research shows increased neural development of children in nurturing, positive, two-parent supported environments. Ensuring children have positive experiences early in life is less costly than later remediation programs for delinquency, drugs, alcohol, and counseling. Community and family support for fatherhood generates a strong return on investment economically and supports the reduction of cost in health disparities for tomorrow?s adults.

We asked a panel of people to tell us what they think fathers offer, and here are some key thoughts:

  • Fathers define a sense of community, steering interest in community events, outdoors, sports or athletics. Children tend to emulate parents in their own family and their involvement in community later on in life which can result in fewer coaches, less offered activities, and less emphasis on active participation in community events.
  • Fathers provide structure and resources to support their children that lasts a lifetime.
  • Fathers define roles, relationships, and boundaries much different than mothers do.
  • Fathers have a direct impact on the morals of children and community that will affect our future.
  • Fathers often teach children how to behave by following through.
  • Fathers are a different type of role model for our youth than mothers are.

Is the loss of fatherhood involvement one of the evident tragedies of our times? Have we seriously overlooked the huge impact involved fathers have on their children? Have we chosen to focus on a tug of war in what rights they have, simply because they offer different things than women offer to their children? Prejudice from courts to maternal grandparents have kept many fathers from successfully engaging with their child. As early as birth, a child bonds to both their parents in equal ways. If a father misses early opportunities to be with their child during this stage, a child may become fussy and reject attempts to connect, putting fathers who await long court battles at a very big disadvantage resulting in a loss for both father and child.

It seems we expect fathers to be ?doers? when a child is born rather than just take some time to be with their baby. Those facing unplanned pregnancy may not be in a place to be ?doers,? especially if it is a young father. Society benefits if we help fathers nourish successful involvement with their child from the start in the same way we do for our young mothers. If we afford a mother community supports and education, and allow them to take the necessary time to spend with their child during the adjustment to motherhood, we should offer men the same until some life skills and structures begin to develop.

dad3Who is to say a young man should be rejected because he is not ready to be the full bread winner at the moment of an unplanned pregnancy. His lost opportunities to bond and attach to his child increases the risk of not staying engaged in his child?s life and negatively impacts the child?s development. Men are not always going to be anything more than ?manly? raising their child, and research shows this is biologically evident for optimal human development when both a man and a woman have a lifelong successful relationship with a child. Even the way that a man handles an infant helps that child?s neurodevelopment. It?s in the great design to have the influence of a father or father figure and a mother or mother figure. Let?s make every effort to support the success of our fathers and not banish them from parenthood or chase them away with messages on unsuccessful ?fatherdom? because of immaturity, personal vendettas, or inability to know what to do.

Many communities across the United States have begun to recognize the value of successful fatherhood and have advocated and supported efforts to increase fatherhood engagement. Russia debates letting Snowden in from the cold

Former National Security Agency contractor Edward Snowden, who Russian officials say is spending his sixth day hiding somewhere in Moscow's cavernous Sheremetyevo airport, has still not been heard from or even spotted by journalists who've been eagerly combing the transit zone for a glimpse of him.

But his presence has not passed unnoticed in Moscow political circles, where a growing number of voices are suggesting that he should be brought in from the cold and offered asylum in Russia.

While a skeptic may perceive a cynical streak behind the unfolding public discussion ? a desire to exploit Mr. Snowden's situation for propaganda points against the US ? it might also be argued that some of the Western concepts being introduced into mainstream Russia political discourse, pretty much for the first time, may be hard to put back in the box later.

One prominent theme is the jarring notion that the old cold war paradigm ? the US-led "free world" versus the Soviet "evil empire" ? is being been stood on its head, and the US now looks like a ponderous, bureaucratic police state, while modern Russia has morphed into a beacon of hope for Western freedom-seekers.

"[Julian] Assange, [Bradley] Manning and Snowden are not spies who sold classified information for money. They acted on their beliefs. They are new dissidents, fighters against the system," the head of the State Duma's international affairs committee, Alexei Pushkov, tweeted Wednesday.

Mr. Pushkov, who excels at skewering Western "double standards," has maintained a steady stream of similar comments on his Twitter feed in recent days.

"The idealist Snowden was apparently convinced it would all turn out like a Hollywood movie: he will expose abuses and democracy will prevail. But life, and the US, are tougher," he tweeted Friday.

A somewhat different tack was taken by the head of the Kremlin's in-house human rights commission, Mikhail Fedotov, who told journalists that Snowden "deserves protection" and should file a request for refuge in Russia.

"If Mr. Snowden files such a request, then it can be considered by the president," Fedotov told the independent Interfax agency on Thursday.

"This situation is utterly clear to me from the point of view of human rights protection: a person, disclosing secrets concealed by special services, if these secrets are a threat to the society, a threat to millions people ? which refers to the total surveillance of the Internet ? such a person does deserve political asylum in this or that country," Fedotov said.

The official line, expressed by President Vladimir Putin, is that Russia will not hand Snowden over to the US but that he should move on, the sooner the better.

Before he goes, however, Russia's Federation Council, the upper house of parliament, has struck a special committee and invited him in to testify about the impact of NSA spying on Russian citizens.

Sen. Ruslan Gattarov, head of the Federation Council's working group to investigate Snowden's claims, says his main concern is not to investigate the NSA.

He insists the committee's key interest is to explore the alleged abuse-of-trust by giant Internet companies ? such as Google, Yahoo, and Facebook, and others with huge slices of the Russian market ? which Snowden's revelations suggest have handed over user data to the NSA.

"We don't want to get involved in secret service conspiracies. Whatever the NSA was doing is not particularly our concern," Mr. Gattarov says.

"We want to know how it happens that big global Internet companies, which operate in Russia, too, find it possible to leak user data to a third party. The public has been assured by these companies that our personal correspondence, our bank accounts, our Internet habits are all perfectly secure. But what we're learning from Mr. Snowden's exposures strongly suggest otherwise."

"So, we want to talk with him. As soon as he settles his status, we invite him to come to the Federation Council and discuss with us any evidence that is relevant to this probe," he adds.

Sergei Markov, a frequent adviser to President Putin, says the growing public debate over what to do about Snowden really is something new, and it puts the Kremlin in a difficult spot.

"Russia really would prefer if Snowden went somewhere else, but it is quite possible that we'd take him in if he asked for asylum here. It would create difficulties with the US, but Russia would lose a lot of credibility if it were to turn him down," Mr. Markov says.

"Of course, Snowden probably doesn't want refuge in Russia. He belongs to international civil society, the so-called 'warriors of freedom,' who probably dislike Russia as much as they do the US. He'd probably see Russian asylum as the total failure of his mission. But in Russian society, there is a real, very healthy discussion going on about this. People are reexamining their beliefs. For example, human rights advocates who normally just criticize the Kremlin are being forced to answer the question: Are you more pro-American, or more pro-human rights?" he says.

"If you're more pro-human rights, it means you should support Snowden even if it means offending the US."

Dozens hospitalized as West bakes in near-record heat

(Reuters) - More than 170 people were treated for heat-related ailments and some towns and cities took emergency steps to protect the homeless and elderly as the West sweltered on Saturday in dangerous near-record, triple-digit temperatures.

Extreme heat enveloped most of California and Nevada and parts of southern Arizona as a large high pressure system trapped hot air across the area, said National Weather Service meteorologist Todd Lericos.

More than 170 people were "treated for heat-related injuries" and 34 more were sent to local hospitals while attending an outdoor concert on Friday afternoon in Las Vegas, Nevada, where temperatures soared to 115 degrees Fahrenheit (46 C), said Erik Pappa, a spokesman for Clark County. On Saturday, highs are expected to reach 117 (47 C).

"It involves pretty much the entire West Coast at this point," Lericos said, adding that the steamy conditions, which began in some pockets on Thursday afternoon, will likely continue throughout the weekend and linger into next week.

Temperatures were well into the triple-digits in most of the area, except in higher elevations.

In Death Valley, one of the hottest places on earth, temperatures could soar on Saturday to 128 F (53 C), close to the daily record set in 1994. Other areas in and around the Mojave Desert will see triple-digit temperatures.

The "exceedingly high temperatures" can cause potentially fatal heat stroke, Lericos said, noting that those with no air-conditioning or who must work outdoors were particularly at risk.

In an effort to safeguard hundreds of homeless in Phoenix, where temperatures could hit 120 F (48 C) on Saturday, emergency shelters are temporarily adding 150 beds.

The National Weather Service said the heat warning remains in place through Sunday, and could be extended into next week should the conditions persist.

Areas in the more temperate Pacific Northwest, such as Seattle and Spokane, Washington, and Pendleton, Oregon, face hot weather over the weekend and early next week as the heat moves northward, Lericos said.

According to the Fair Isaac Corporation (FICO), high credit achievers have accounts that are usually at least 11 years old.

Excellent credit could qualify you for a better interest rate, which might save you thousands of dollars over the life of the loan. So stay on top of your monthly credit bills and keep a low balance on just a few cards to watch your score steadily increase.

President Obama?s announcement on Tuesday that he will use his executive authority to regulate carbon-dioxide emissions from existing power plants, and to finalize rules for plants that have yet to be built, is reason to celebrate ? but also an occasion for mourning. The announcement reflects Congress?s refusal to pass serious laws to curb greenhouse-gas emissions. Ultimately, if America is to fully contribute to an effective global response to the perils of a warming planet, Congress must stop dithering.

    Obama's Climate Bell Tolls Loudly and Poorly for Virginia Coal Fields

    Yahoo News asked voters to comment on President Barack Obama's climate change plan, which he largely unveiled in a speech on Tuesday. Here's one response.

    COMMENTARY l Living near Roanoke in the coalfields of southwest Virginia, it was difficult to continue to hope for economic recovery in this region after President Obama's recent speech. The cities, towns and communities in the area are dependent on one thing: coal.

    Obama's words are a final bell sadly tolling this truth: Our way of life is over. If Obama's proposals go through, it will decimate our already languishing economy.

    Politicians can talk about the need for coal-dependent economies to diversify, and the need for workers to be retrained and learn new skills, but all of these strategies take time to implement, time that families in the coalfields do not have.

    Obama ignores the dark side to the utopian goal of reducing carbon emissions by destroying the coal industry -- the truth. Renewable sources of energy are incredibly expensive, undependable and inefficient. Few sources of energy are as cheap and reliable as coal. Rapidly changing energy sources will lead to rising energy costs for households and businesses throughout the nation when few can afford it. Increased costs from changing energy sources will result in dramatic increases in energy costs, and the cost of production will rise for everything else, this will result in rapid growth in both unemployment and inflation throughout the country.

    Congratulations, President Obama, you've kept your campaign promise about "fundamentally changing the nation." Most still don't understand that your "change" means destroying our economy and ability to earn a living as you build your brave new Big Brother-esque empire.

    South Africa: Emotion builds over Mandela

    JOHANNESBURG (AP) ? South Africans were torn on Wednesday between the desire not to lose a critically ill Nelson Mandela, who defined the aspirations of so many of his compatriots, and resignation that the beloved former prisoner and president is approaching the end of his life.

    The sense of anticipation and foreboding about 94-year-old Mandela's fate has grown since late Sunday, when the South African government declared that the condition of the statesman, who was rushed to a hospital in Pretoria on June 8, had deteriorated.

    A tide of emotional tributes has built on social media and in hand-written messages and flowers laid outside the hospital and Mandela's home. On Wednesday, about 20 children from a day care center posted a hand-made card outside the hospital and recited a poem.

    "Hold on, old man," was one of the lines in the Zulu poem, according to the South African Press Association.

    In recent days, international leaders, celebrities, athletes and others have praised Mandela, not just as the man who steered South Africa through its tense transition from white racist rule to democracy two decades ago, but as a universal symbol of sacrifice and reconciliation.

    In South Africa's Eastern Cape province, where Mandela grew up, a traditional leader said the time was near for Mandela, who is also known by his clan name, Madiba.

    "I am of the view that if Madiba is no longer enjoying life, and is on life support systems, and is not appreciating what is happening around him, I think the good Lord should take the decision to put him out of his suffering," said the tribal chief, Phathekile Holomisa.

    "I did speak to two of his family members, and of course, they are in a lot of pain, and wish that a miracle might happen, that he recovers again, and he becomes his old self again," he said. "But at the same time they are aware there is a limit what miracles you can have."

    For many South Africans, Mandela's decline is a far more personal matter, echoing the protracted and emotionally draining process of losing one of their own elderly relatives.

    One nugget of wisdom about the arc of life and death came from Matthew Rusznyah, a 9-year-old boy who stopped outside Mandela's home in the Johannesburg neighborhood of Houghton to show his appreciation.

    "We came because we care about Mandela being sick, and we wish we could put a stop to it, like snap our fingers," he said. "But we can't. It's how life works."

    His mother, Lee Rusznyah, said Mandela, who spent 27 years in prison under apartheid before becoming South Africa's first black president in all-race elections in 1994, had made the world a better place.

    "All of us will end," Thabo Makgoba, the Anglican archbishop of Cape Town, said in an interview with The Associated Press on Wednesday. "We just want him to be peacefully released, whatever he's feeling at this moment, and to be reunited with his Maker at the perfect time, when God so wills."

    The archbishop said: "Ultimately, we are all mortal. At some stage or another, we all have to die, and we have to move on, we have to be recalled by our Maker and Redeemer. We have to create that space for Madiba, to come to terms within himself, with that journey."

    On Tuesday, Makgoba visited Mandela and offered a prayer in which he wished for a "peaceful, perfect, end" for the anti-apartheid leader, who was taken to the Pretoria hospital to be treated for what the government said was a recurring lung infection.

    In the prayer, he asked for courage to be granted to Mandela's wife, Graca Machel, and others who love him "at this hard time of watching and waiting," and he appealed for divine help for the medical team treating Mandela.

    Visitors to the hospital on Wednesday included Mandela's former wife, Winnie Madikizela-Mandela. The couple divorced in 1996.

    "As he remains in a critical condition in hospital, we must keep him and the family in our thoughts and prayers every minute," President Jacob Zuma said Wednesday.

    Mandela, whose 95th birthday is on July 18, served a single five-year term as president and afterward focused on charitable causes, but he withdrew from public life years ago and became increasingly frail in recent years. He last made a public appearance in 2010 at the World Cup soccer tournament, which was hosted by South Africa. At that time, he did not speak to the crowd and was bundled against the cold in a stadium full of fans.

    On April 29, state television broadcast footage of a visit by Zuma and other leaders of the ruling party, the African National Congress, to Mandela's home. Zuma said at the time that Mandela was in good shape, but the footage ? the first public images of Mandela in nearly a year ? showed him silent and unresponsive, even when Zuma tried to hold his hand.

    "Let's accept instead of crying," said Lucas Aedwaba, a security officer in Pretoria who described Mandela as a hero. "Let's celebrate that the old man lived and left his legacy."

    Dan Lehman, an American academic, chose a jogging route on Wednesday morning that passed by the hospital where Mandela is being treated.

    "I was just going out for my morning run down here and come to pay my respects to the greatest man in the world," Lehman said. Then he began to cry.

    Senate moves forward on immigration bill

    WASHINGTON (AP) ? The Senate has agreed to spend tens of billions of dollars on a dramatic increase of border security.

    The move comes as senators near passage of immigration legislation offering U.S. citizenship to millions of people.

    The 69-29 vote Wednesday came as the Senate plowed through a few remaining procedural hurdles ahead of final passage. That might happen as early as Thursday.

    Earlier, senators knocked down a Republican objection raised against the bill.

    The outcomes indicate the legislation commands the backing of well over the 60 senators needed to pass the bill and send it to the House, where an uncertain future awaits.

    The White House-backed measure spends tens of billions on border security while establishing a 13-year path to citizenship for 11 million people already here illegally.

    Boost for cars or bust? Ethanol debate heats up

    (AP) ? It's a dilemma for drivers: Do they choose a gasoline that's cheaper and cleaner even if, as opponents say, it could damage older cars and motorcycles?

    That's the peril and promise of a high-ethanol blend of gasoline known as E15. The fuel contains 15 percent ethanol, well above the current 10 percent norm sold at most U.S. gas stations.

    The higher ethanol blend is currently sold in fewer than two dozen stations in the Midwest, but could spread to other regions as the Obama administration considers whether to require more ethanol in gasoline.

    As a result, there's a feverish lobbying campaign by both oil and ethanol interests that has spread from Congress to the White House and the Supreme Court.

    On Monday, the Supreme Court rejected a challenge by the American Petroleum Institute, the oil industry's chief lobbying group, to block sales of E15. The justices left in place a federal appeals court ruling that dismissed challenges by the oil industry group and trade associations representing food producers, restaurants and others.

    Tom Buis, CEO of Growth Energy, an ethanol industry group, hailed the decision as victory for U.S. consumers, who will now have greater choice at the pump.

    "Now that the final word has been issued, I hope that oil companies will begin to work with biofuel producers to help bring new blends into the marketplace that allow for consumer choice and savings," Buis said.

    The API called the decision a loss for consumers, safety and the environment.

    "EPA approved E15 before vehicle testing was complete, and we now know the fuel may cause significant mechanical problems in millions of cars on the road today," said Harry Ng, API vice president and general counsel.

    The ethanol industry called that a scare tactic and said there have been no documented cases of engine breakdowns caused by the high-ethanol blend since limited sales of E15 began last year.

    "This is another example of oil companies unnecessarily scaring people, and it's just flat-out wrong," said Bob Dinneen, president of the Renewable Fuels Association, an ethanol industry group.

    The dispute over E15 is the latest flashpoint in a long-standing battle over the Renewable Fuel Standard, approved by Congress in 2005 and amended in 2007. The law requires refiners to blend increasing amounts of ethanol into gasoline each year as a way to decrease reliance on fossil fuels and lower greenhouse gas emissions that contribute to global warming.

    The Environmental Protection Agency has proposed a 16.5 billion-gallon production requirement for ethanol and other gasoline alternatives this year, up from 15.2 billion gallons last year. By 2022, the law calls for more than double that amount.

    Biofuel advocates and supporters in Congress say the law has helped create more than 400,000 jobs, revitalized rural economies and helped lower foreign oil imports by more than 30 percent while reducing emissions of carbon dioxide and other greenhouse gases.

    But the oil industry, refiners and some environmental groups say the standard imposes an unnecessary economic burden on consumers. Using automotive fuel that comes from corn also has significant consequences for agriculture, putting upward pressure on food prices, critics say.

    "The ever increasing ethanol mandate has become unsustainable, causing a looming crisis for gasoline consumers," said the API's Greco. "We're at the point where refiners are being pressured to put unsafe levels of ethanol in gasoline, which could damage vehicles, harm consumers and wreak havoc on our economy."

    Along with the E15 court case, the API and refiners have swarmed Capitol Hill and the White House to try to have the current mandate waived or repealed.

    Charles Drevna, president of the American Fuel & Petrochemical Manufacturers, which represents refineries, accused the EPA of putting politics ahead of science.

    An EPA official told Congress earlier this month that the agency does not require use of E15, but believes it is safe for cars built since 2001.

    "The government is not saying 'go ahead' " and put E15 in all cars, said Christopher Grundler, of the EPA's director of the office of transportation and air quality. "The government is saying this is legal fuel to sell if the market demands it and there are people who wish to sell it."

    Ethanol supporters say E15 is cheaper than conventional gasoline and offers similar mileage to E10, the version that is sold in most U.S. stations.

    Scott Zaremba, who owns a chain of gas stations in Kansas, scoffs at claims that E15 would damage older cars. "In the real world I've had zero problems" with engine breakdowns, said Zaremba, whose station in Lawrence, Kan., was the first in the nation to offer E15 last year.

    But Zaremba said he had to stop selling the fuel this spring after his gasoline supplier, Phillips 66, told him he could no longer sell the E15 fuel from his regular black fuel hoses. The company said the aim was to distinguish E15 from other gasoline with less ethanol, but Zaremba said the real goal was to discourage use of E15. New pumps cost more than $100,000.

    The American Automobile Association, for now, sides with the oil industry. The motoring club says the government should halt sales of E15 until additional testing allows ethanol producers and automakers to agree on which vehicles can safely use E15 while ensuring that consumers are adequately informed of risks.

    A spokeswoman for the Alliance of Automobile Manufacturers, which represents 12 major car makers, said E15 gas is more corrosive and the EPA approved it before it could be fully tested.

    Older cars were "never designed to use E15," spokeswoman Gloria Bergquist said. Use of the fuel over time could create significant engine problems, she said.

    The API cites engine problems discovered during a study it commissioned last year, but the Energy Department called the research flawed and said it included engines with known durability issues.

    For now, E15 remains a regional anomaly. About 20 stations currently offer the fuel in Illinois, Iowa, Kansas, Nebraska, South Dakota and Wisconsin.

    Dinneen and other ethanol advocates said the Supreme Court ruling may serve as a breakthrough for E15, after years of delay.

    "With this decision, E15 can finally become a meaningful option for more Americans," Dinneen said.

    In 1895, George Selden patented the ?improved road engine? powered by a ?liquid-hydrocarbon engine of the compression type.? In other words, he patented the car.

    In 2003, Apple patented the glass staircase that appears in some of their stores.

    In 2012, Apple successfully sued Samsung for creating a screen that can distinguish between 1 or 2 fingers touching it. They also sued Samsung for copying the iPhone shapes, white and black colors, and rounded icons, among other things.

    And today, Google Maps might get shut down in Germany for violating Microsoft?s patent on ?computer system for identifying local resources and method therefor.?

    Of the above cases, only Selden?s patent was successfully challenged in 1911, thanks to Henry Ford. The others still stand along with Amazon?s patent on a one-click purchase button.

    The absurdity of these patents is not even half as frustrating as the shameless efforts to exploit the broken system. Apple, Samsung, Microsoft, Google, Nokia and HTC spend billions in the so-called ?smartphone wars? trying to strangle each other in the courts, rather than spending hard-earned cash on R&D. Patent Assertion Entities (PAEs), also known as ?patent trolls,? acquire patents with no intention to ever develop the products or processes: they simply aim to collect licensing fees or blackmail companies into settlements.

    If Selden could not maintain such an absurd patent in 1911, why can software companies today secure even more preposterous patents? Why can companies exploit erroneous patents to bleed out competitors, stifle innovation, and squash upstarts? Why can ?patent trolls? so easily exploit America?s innovators?

    Legislation Has Fallen Short

    The US patent system is not only broken?it?s being flagrantly abused to stifle innovation, penalize inventors, and lock great companies into epically pointless litigation from which only lawyers leave the better.

    Government efforts to address this issue have been underwhelming and ineffective.

    On September 16, 2011, President Obama signed the Leahy-Smith America Invents Act (AIA), aiming to protect startup innovators from legal tricks utilized by moneyed infringers. However, the AIA did not go far enough, and has in fact backfired. Ex parte patent reexaminations have tripled since the bill came into force because patent infringers now blackmail patent-holders with the threat of reexamination. The bill was supposed to reduce legal threats.

    The new ?First Inventor to File? rules, which replaced the age-old ?First to Invent? standard, have also reduced startup access to venture capital, since startups often do not have a sufficient conception, proof of functionality and business plan until after they earn venture backing. Conversely, venture capitalists cannot risk backing companies until they have the patent. Both investors and high-tech startups now struggle with this Catch-22.

    The problem is getting worse: suits brought by patent trolls have actually increased from 29% of all infringement suits to 62% of all infringement suits over the last 2 years alone. The White House claims that trolls may have threatened over 100,000 companies in the past year.

    At this point, the patent system cannot be band-aided so easily, despite the White House?s best intentions. On June 4, the Obama administration announced 5 executive actions and 7 legislative recommendations to better protect America?s innovators. They are a mixed bag.

    Encouragingly, the White House wants congress to give district courts discretion to make abusive plaintiffs responsible for the defendant?s legal fees, and they want Congress to incentivize public filing of demand letters to limit abusive suits. Making plaintiffs responsible for legal fees could deter unscrupulous companies from attempting to hemorrhage competitors, who are strong-arming them for licensing fees with the threat of legal action if they don?t comply.

    The Executive Orders demand:

    1. That patent applicants and owners regularly update ownership information so that trolls cannot use shell companies to hide the full extent of their patent holdings from companies they target in abusive litigation.
    2. That the Patent and Trademark Office (PTO) train examiners to weed out overly broad software patent claims.
    3. That the PTO creates ?education and outreach materials? that ?offer answers to common questions by those facing demands from a possible troll.?
    4. That more research, discussion, and data production occur.
    5. A review of procedures that Custom and Borders Protection and the International Trade Commission use to evaluate exclusions barring the import of infringing goods.

    Despite the nice intentions, the White House has not done enough to stem abusive patent litigation. As it stands, a company could probably patent the process of embedding Google Maps on a webpage?or patent the ability to purchase products and services inside a mobile app. Oh, wait, Lodsys already has that patent.

    If profoundly ludicrous patents breeze through the Patent and Trademark Office, trolls prey on companies, big companies prey on little companies, and tech giants slap lawsuits to each other like leeches, clearly patent law is broken. Congress must take stronger measures to stop the bullying and set America back on a path of innovation.

    In line with the Electronic Frontier Foundation?s Defend Innovation Project, I recommend seven simple changes to patent law that would stem the unchecked growth of exploitative litigation:

    1. Software patents should last no longer than five years from the application date.

    Currently, patents last for twenty years, which is an outdated time frame given the pace of software innovation. Patent lengths should reflect the speed of innovation within individual industries.

    2. If a patent is invalid or there is not infringement, the plaintiff should be responsible for the legal fees.

    Trolls and predatory tech companies frequently use the threat of a protracted legal battle to blackmail alleged infringers into an out-of-court settlement, even though the defendant would probably win in court. Making the plaintiff responsible will discourage this abuse.

    3. Patent applicants should be required to provide an example of running software code for each claim in the patent.

    If a patent troll lacks the ability to implement a software concept, why does it deserve a patent? Do I deserve a patent for a hovering skateboard that I cannot create? Absolutely not. This requirement would prevent trolls from patenting concepts and processes that they intend to exploit rather than produce. This will let great thinkers and inventors actually bring these ideas to market.

    4. Infringers should not be liable for independently arriving at a patented invention.

    Software code is mathematics ? therefore, it should come as no surprise that multiple people often reach the same or similar code. Making such independent innovators liable is like accusing a student of plagiarism because he or she solved a math problem but submitted the exam after another student. You should not be able to patent common sense processes and single-answer solutions.

    5. Patents and licenses should be public right away.

    Otherwise, how can innovators know if they are infringing on a patent? It?s wrong to let enterprising coders invest time, money, and passion into a product only to fall into a patent troll?s booby trap. Patent owners should be required to keep their public records up-to-date.

    6. Patent law should limit damages so that a patent owner cannot collect millions of dollars if the patent represented only a tiny fraction of a defendant?s product.

    Should a teenager get the death penalty for stealing a candy bar? No. Then why should a startup be given the fiscal death penalty for infringing on a patent that is a miniscule component of their software? If an alleged infringer is not making millions on a patent, they should not be liable for millions.

    7. Congress should commission a study and hold hearings to examine whether software patents actually benefit the economy.

    According to researchers form the Technical University of Lisbon, a stunning 91% of all technologies that have received an ?R&D 100 Award? from the academic journal Research & Development between 1977 and 2004 were not patented. Across the board, scholarly studies have challenged the notion that patents protect economically useful inventions. Indeed, mounting evidence shows that the opposite is true ? patents stifle more innovations than they protect.

    Only countries with enlightened legal institutions can sustain long-term economic growth, facilitate innovation, and benefit from the genius of resourceful creators. So long as malicious companies and opportunistic patent assertion entities can cannibalize the productivity and ingenuity of America?s tech community, advancements will stall, great ideas will crash before they ever take off.
