On the same day that former Saints assistant Mike Cerullo testified in the bounty appeal hearing convened by former Commissioner Paul Tagliabue, Judge Helen Berrigan issued a reminder that she has ultimate jurisdiction over the process.

Larry Holder of the New Orleans Times-Picayune has obtained an order entered by Judge Berrigan on Thursday.? Here?s the full text of it:? ?In light of the CBA Appeal Panel?s Decision of September 7, 2012, that ?pay for performance? discipline was within the exclusive jurisdiction of the Systems Arbitrator, anticipating that the forthcoming decision by Mr. Tagliabue may be subject to an expedited review as to its fundamental fairness, and assuming as undisputed the testimony by the New Orleans Saints players and coaches that only ?legal hits? were used to intimidate and/or injure opposing players, the parties shall brief the following: 1. Does Articles 43 and 46 of the CBA exclude discipline by the Commissioner for ?legal? contact? 2. Does the CBA give the players and coaches adequate notice as to what conduct could be sanctioned as ?conduct detrimental?? In other words, is that portion of the CBA ambiguous, hence unenforceable? Counsel should discuss the significance, if any, of the separate provision for sanctions upon players for ?unnecessary roughness or unsportsmanlike conduct on the playing field with respect to an opposing player? in Article 46, Section 1(b) from ?[a]ll disputes involving a fine or suspension imposed upon a player for conduct on the playing field? and ?conduct detrimental? in Section 1(a). Reference to relevant NFL rules defining ?legal? and ?illegal? contact is welcomed, as well as a discussion of examples of ?conduct detrimental? provided in the CBA and related documents.?

In English, Judge Berrigan wants the parties to submit written documents that address specific angles and issues that may be relevant to her decision about the imposition of punishment on players for a pay-for-performance system based on clean, legal hits that kept opponents from continuing in a given game.? The way the questions are written suggests that she has identified specific problems that the NFL may have under the Collective Bargaining Agreement.

For example, Judge Berrigan wants the parties to address whether discipline for ?legal? on-field contact is prevented because she apparently thinks it may be.? Likewise, she wants to know whether the CBA gives players and coaches ?adequate notice? regarding the conduct that could be regarded as ?conduct detrimental? because she thinks it may not.

Judge Berrigan also seems to think that the punishment for clean, legal hits falls under the portion of the CBA that gives Ted Cottrell or Art Shell exclusive jurisdiction over the disciplinary process ? an argument that the NFL surely will argue the players have waived by not raising it under the CBA.

Regardless of the arguments raised by the parties, the order seems to be good news for the players, and bad news for the NFL.? The fact that it was issued at a time when key witnesses in the case against the players are testifying could rattle the league?s lawyers and create a sense that, no matter what happens before Tagliabue, the suspensions will ultimately be thrown out.

Two winners in record Powerball jackpot

Winning tickets for the record Powerball jackpot worth more than $587 million were purchased in Arizona and Missouri.

Missouri Lottery official Susan Goedde confirmed to ABC News this morning that one of the winning tickets was purchased in the state, but they would not announce which town until later this morning.

Arizona lottery officials said they had no information on that state's winner or winners but would announce where it was sold during a news conference later in the day.

The winning numbers for the jackpot were 5, 23, 16, 22 and 29. The Powerball was 6.

The jackpot swelled to $587.5 million, according to Lottery official Sue Dooley. The two winners will split the jackpot each getting $293.75 million. The cash payout is $192.5 million each.

An additional 8,924,123 players won smaller prizes, according to Powerball's website.

"There were 58 winners of $1 million and there were eight winners of $2 million. So a total of $74 million," said Chuck Strutt, Director of the Multi-State Lottery Association.

This is the 27th win for Missouri, ranking it second in the nation for lottery winners after Indiana, which has 38 wins. Arizona has had 10 Powerball jackpot wins in its history.

Players bought tickets at the rate of 131,000 every minute up until an hour before the deadline of 11 p.m. ET, according to lottery officials.

The jackpot had already rolled over 16 consecutive times without a winner. That fact, plus the doubling in price of a Powerball ticket, accounted for the unprecedented richness of the pot.

"Back in January, we moved Powerball from being a $1 game to $2," said Mary Neubauer, a spokeswoman at the game's headquarters in Iowa. "We thought at the time that this would mean bigger and faster-growing jackpots."

That proved true. The total, she said, began taking "huge jumps -- another $100 million since Saturday." It then jumped another $50 million.

The biggest Powerball pot on record until now -- $365 million -- was won in 2006 by eight Lincoln, Neb., co-workers. As the latest pot swelled, lottery officials said they began getting phone calls from all around the world.

"When it gets this big," said Neubauer, "we get inquiries from Canada and Europe from people wanting to know if they can buy a ticket. They ask if they can FedEx us the money."

The answer she has to give them, she said, is: "Sorry, no. You have to buy a ticket in a member state from a licensed retail location."

About 80 percent of players don't choose their own Powerball number, opting instead for a computer-generated one. Asked if there's anything a player can do to improve his or her odds of winning, Neubauer said there isn't -- apart from buying a ticket, of course.

Lottery officials put the odds of winning this Powerball pot at one in 175 million, meaning you'd have been 25 times more likely to win an Academy Award.

Skip Garibaldi, a professor of mathematics at Emory University in Atlanta, provided additional perspective: You are three times more likely to die from a falling coconut, he said; seven times more likely to die from fireworks, "and way more likely to die from flesh-eating bacteria" (115 fatalities a year) than you are to win the Powerball lottery.

Segueing, then, from death to life, Garibaldi noted that even the best physicians, equipped with the most up-to-date equipment, can't predict the timing of a child's birth with much accuracy.

"But let's suppose," he said, "that your doctor managed to predict the day, the hour, the minute and the second your baby would be born."

The doctor's uncanny prediction would be "at least 100 times" more likely than your winning.

Even though he knows the odds all too well, Garibaldi said he usually plays the lottery.

When it gets this big, I'll buy a couple of tickets," he said. "It's kind of exciting. You get this feeling of anticipation. You get to think about the fantasy."

So, did he buy two tickets this time?

"I couldn't," he told ABC News. "I'm in California" -- one of eight states that doesn't offer Powerball.

In case you were wondering, this Saturday's Powerball jackpot is starting at $40 million.

Is Your Social Media Behavior Annoying? | Business 2 Community

Are you trying to annoy me?

Most people annoy someone with their behavior. Often, we don?t know our behavior is annoying to others. Yet, some don?t care if their behavior annoys others. One interesting thing about social media is that it gives people the opportunity to be annoying on a very large stage. Whether you are using social media for personal or business communication, annoying your audience will not win you any friends. When using social media for business, a good impression and a strong relationship are important. Therefore, you should ask periodically, is your social media behavior annoying?

Personally, I find people who carry on loud conversations by cell phone in a quiet restaurant very annoying. In fact, I find it annoying when people have loud phone conversations in any crowded place. I don?t want to hear their conversations (especially when they are heavily laced with profanity), and I?m guessing the same is true for everyone else in the room. People find different things annoying. Often, the only way to know we are annoying someone is for somebody to tell us.

Several recent studies have identified some of the social media behaviors that are most annoying to audiences. Their importance lies in the fact that 65 percent of people who are annoyed or irritated by the social media behavior of a business say they would stop using a brand if annoyed. Are you losing customers and prospects because of your social media behavior?

One study (conducted by Vanson Bourne) found that unsolicited social media marketing is the most irritating social media experience for audiences. Although most respondents to the survey said they did not mind social interaction or messages from brands they have already bought and followed online, receiving messages from a business they did not follow would irritate 40 percent of the respondents. In fact, less than half (48%) said they want to receive marketing messages at all.

On the other hand, the same survey found that 68 percent of consumers had researched a product or service recommended by a friend online. Fifteen percent of those people made a purchase based on the recommendation. This indicates that although people do not want to receive marketing messages from businesses, word-of-mouth-recommendation is alive and well.

Another study, conducted by MediaBrix in October 2012, found that people also find content that is nothing more than a disguise for advertising annoying. Some consumers are beginning to push back against this type of content. The study found that 86 percent of consumers surveyed reported encountering video ads disguised as content. What is more, nearly all of them (85%) said disguised ads have changed their opinion of the brand negatively or had no effect.

The content found annoying by respondents to this survey who had encountered it included:

  • Sponsored video ads that appear to be content (86%)
  • Advertorials (66%)
  • Infomercials (61%)
  • Facebook Sponsored Stories (57%)
  • Twitter Promoted Tweets (45%)

The MediaBrox study also found that a large proportion of marketers believe these advertisements are effective.

A third study, conducted by Edelman Berland for Adobe in late October 2012, documented a significant difference of opinion between consumers and marketers about the type of advertising believed effective. This chart summarizes where consumers want to see advertising:

The message for businesses from these three studies seems clear ? consumers do not want advertising via social media. Advertising to them via social media is irritating. Contacting consumers who have not chosen to follow you on-line is annoying to them. Disguising advertising as content is also irritating. If you are practicing any of these social media behaviors, you are annoying your audience. Stop annoying people. More and more people who are annoyed by businesses are pushing back and harboring bad feelings about them.

Is your social media behavior annoying? If it is, you need to start producing content that is relevant and valuable to your target audience. You also need to focus your content sharing on people who want to hear from you and stop spamming strangers.

Observatory: Holes in Art Prints Help Map Beetle Populations in Europe

Blair Hedges, an evolutionary biologist at Penn State, is also a collector of Renaissance art. For years, he wondered about the ?wormholes,? the tiny holes that beetles bored in the wood blocks used to make prints ? ?how these got there,? as he put it, ?and what species they were from.?

Now Dr. Hedges has done a study of prints from 1462 to 1899 and determined that the wormholes tell a story about the geographic distribution of beetles in Europe.

?The prints have the date and place of publication,? said Dr. Hedges, who reports his findings in the journal Biology Letters. ?It?s almost the perfect fossil.?

Beetles lay their eggs in the cracks and crevices of wood blocks, and then larvae spend several years dining on the wood?s cellulose. Adult beetles exit the wood, leaving behind the wormhole.

When the wood block is used to make a print, it leaves a small hole, absent of ink, Dr. Hedges realized.

In 2006, he created a statistical method for dating antique prints and books by studying the imprints of cracks in prints made from wood blocks. He first noticed the wormholes then.

He measured more than 3,000 wormholes in antique prints. It turned out that prints from northern Europe had wormholes about five-hundredths of an inch wide, probably caused by Anobium punctatum, the common furniture beetle; prints from the south had larger circles, about nine-hundredths of an inch wide, probably caused by the Mediterranean furniture beetle.

For 500 years, the two species did not overlap, he said. Today both species are found in northern and southern Europe.

Syria: Twin car bombs in Damascus kill 34 people

DAMASCUS, Syria (AP) ? Twin car bombs ripped through a Damascus suburb on Wednesday, killing at least 34 people and leaving dozens critically wounded, according to state media and hospital officials.

The state news agency, SANA, said two cars packed with explosives detonated early in the morning in the eastern Jaramana suburb, a district that is mostly loyal to President Bashar Assad. The area is populated mostly by Christians and Druse, a minority sect.

A series of blasts have struck regime targets in Damascus and elsewhere since last December, raising fears of a rising Islamic militant element among the forces seeking to topple Assad.

Wednesday's car bombs went off in a parking lot located between two commercial buildings. They were detonated within five minutes of one another as groups of laborers and employees were arriving to work.

The blasts shattered windows in nearby buildings, littering the street with glass and debris. Human remains were scattered on the pavement, amid pools of blood.

There were conflicting reports about the death toll, however.

Two hospital officials, speaking on condition of anonymity because they were not authorized to talk to the media, said at least 30 bodies were brought to two nearby hospitals. Activists with the Britain-based Observatory for Human Rights say 29 people were killed. The activist group relies on reports from the ground.

The different tolls could not immediately be reconciled. Syria restricts independent media coverage.

The conflict in Syria started 20 months ago as an uprising against Assad, whose family has ruled the country for four decades. The conflict quickly morphed into a civil war, with rebels taking up arms to fight back against a bloody crackdown by the government. According to activists, some 40,000 people have been killed since March 2011.

Assad blames the revolt on a conspiracy to destroy Syria, saying the uprising is being driven by foreign "terrorists" ? a term the authorities use for the rebels ? and not Syrians seeking change.

Analysts say most of those fighting Assad's regime are ordinary Syrians and soldiers who have defected, disenchanted with the authoritarian government. But increasingly, foreign fighters and those adhering to an extremist Islamist ideology are turning up on the front lines. The rebels try to play down the Islamists' influence for fear of alienating Western support.

There was no immediate claim of responsibility for Wednesday's bombings.

Rebels fighting to topple Assad are predominantly members of the Sunni Muslim majority. In their push to take Damascus, they have frequently targeted state institutions and troops around the country. They have also often hit districts around the capital with the country's minority communities, perceived to be allied with Assad's Alawite sect, an offshoot Shiite group that dominates the regime.

Downtown Damascus ? the seat of Assad's power ? has seen scores of car bombs and mortar attacks, targeting state security institutions and troops, as well as areas with homes of wealthy Syrians, army officers, security officials and other members of the regime.

Tehran's move this year to use a big part of its most sensitive material - which could otherwise be turned into bomb-grade uranium - for civilian fuel purposes helped ease intense speculation of an imminent attack by the Jewish state.

But tension may soon flare again if Iran's holding were to rapidly approach an amount that would be enough for a weapon, either by stepping up output of higher-enriched uranium or by no longer using the material to produce reactor fuel, or both.

"The question is, at what point do they cross the critical point ... when we enter the danger zone?" one senior diplomatic source said. "Will they decide to voluntarily decide to stay clear of that point?"

A U.N. nuclear watchdog report issued this month showed that Iran in late September suddenly stopped converting uranium gas enriched to a fissile concentration of 20 percent into oxide powder to make fuel for a medical research reactor in Tehran.

Because Iran's enrichment work at the same time continued unabated, the halt meant that its stockpile of the higher-grade uranium rose by nearly 50 percent to 135 kg in November compared with the level in the previous quarterly report in August.

"It is very puzzling," said one intelligence official from a country which suspects Iran is seeking to develop a nuclear weapons capability, a charge Tehran denies, about the finding reported by the U.N. International Atomic Energy Agency (IAEA).

It could be because of a technical malfunction or a "test balloon" to see how the West would react, the official added.

It took Iran a significant step closer to the amount of roughly 250 kg seen as sufficient for one atomic bomb if refined further, which Israel has signaled is a "red line" for Iran's nuclear program that may be reached by mid-2013.

"By the late spring, at this pace, Iran will have more than enough to arm its first weapon," said Emanuele Ottolenghi of the Foundation for the Defense of Democracies, a think-tank which has advised the U.S. government on sanctions against Iran.

But some Western diplomats and analysts believe Iran may have let its stockpile grow for reasons related to the fuel manufacturing process, and that it could at some point re-start conversion of uranium gas.

"I think it is a technical issue," one envoy said.

Producing reactor fuel involves several steps. First, the enriched uranium must be converted into oxide powder, then it is turned into fuel plates, and this could help explain the halt in feeding more of the gas into production process.

"It is probably because it is easier and quicker to make the conversion to oxide than to produce the fuel elements," Mark Fitzpatrick, a nuclear proliferation expert at the International Institute for Strategic Studies think-tank, said.

Fitzpatrick said he believed it was "more of a bottleneck" issue, adding: "It is alarming because it brings the 20 percent stockpile closer to a weapons amount. But it is not alarming in the sense that this was a strategic decision on Iran's part."

DANGER ZONE?

Former chief U.N. nuclear inspector Olli Heinonen said he did not find the Iranian nuclear fuel development unusual.

"This is not an industrial manufacturing process, but rather a pilot scale operation," Heinonen, now at Harvard University, said about the production of 20 percent reactor fuel in a facility near the city of Isfahan, which started in late 2011.

"To turn all the material in Isfahan to fuel plates will take more than year. Before doing so, they also want to see the performance of the plates," Heinonen said.

Even so, Western diplomats and others said, Iran's growing accumulation of 20 percent refined uranium in combination with a major expansion of its enrichment capacity in an underground facility are increasing concern over Tehran's intentions.

It may also further complicate diplomatic efforts to resolve the decade-old dispute peacefully as major powers demand that Iran stop all 20 percent enrichment, shut down the Fordow underground site and ship out the stockpile of the material.

"By converting (20 percent uranium) into something else, it reduces the tension, but in no way does it resolve the issue as a whole. They continue to enrich," the diplomatic source said.

Iran says it wants a recognition of what it sees as its right to refine uranium for peaceful energy purposes and a lifting of sanctions, demands rejected by Western powers.

The United States and its allies are especially watching how much 20 percent uranium Iran is amassing, as this is a short technical step away from the 90 percent level needed for bombs.

Iran has sharply expanded this activity - which compares to the 3.5 percent level needed for most nuclear power plants - over the last year to about 15 kg per month.

By August, Iran had produced 233 kg since the work started in early 2010. About 40 percent has been fed into conversion for making fuel, or was about to be, a step that at least for the time being removed it from any dash for a bomb.

Western diplomats are now waiting to see when Iran will switch on about 700 newly-installed centrifuges at Fordow, which would allow it to sharply expand 20 percent enrichment and once again raise the stakes in its stand-off with its foes.

"I think Iran has been trying to calibrate its advances, not necessarily to lower tension, but to try to manage the crisis," Fitzpatrick said.

Arafat's bones could reveal polonium poisoning

The body of Yasser Arafat is set to be exhumed tomorrow in an effort to determine whether his death in 2004 was caused by polonium-210 poisoning. Tests earlier this year found unusually high levels of the radioactive material on the former Palestinian leader's clothes and toothbrush, but it's still unclear whether Arafat was murdered. Could tests on his bones eight years after his death finally solve the mystery?

Why is Arafat's death such a puzzle?
When Arafat died at a French military hospital, his doctors could not establish a cause of death. Medical records obtained by The New York Times in 2005 suggest he died from a stroke resulting from a bleeding disorder caused by an unknown infection. But Swiss scientists working with the Al Jazeera news organisation tested a urine stain on Arafat's underwear for radioactive polonium-210 and found that it measured 180 millibecquerels (mBq). They also found 54 mBq on his toothbrush. A control garment belonging to Arafat measured just 6.7 mBq.

Those results were deemed inconclusive, as Arafat's possessions could have been contaminated after his death. However, after hearing a deposition from Arafat's widow, Suha, French prosecutors decided to open a murder inquiry in August that is still ongoing.

What is polonium-210, and what can it do to the body?
Polonium-210 is normally created in nuclear reactors. It is highly radioactive, and ingesting even small doses can be fatal. After entering the bloodstream, it goes predominantly to the liver and kidneys along with the bone marrow, says Patrick Regan, who studies radiation physics at the University of Surrey in Guildford, UK.

Former Soviet spy Alexander Litvinenko, who died from the first documented case of polonium poisoning in 2006, was initially admitted to hospital with severe diarrhoea and vomiting. His hair later fell out and his skin turned yellow, indicating liver problems before his death. Arafat was also vomiting and had flu-like symptoms when he went into hospital.

Why choose polonium-210 instead of another poison?
Polonium-210 can be rendered tasteless in a solution as a citrate, nitrate or other salt, making it easy to slip into a drink undetected. It also emits short-range alpha radiation, which cannot be picked up by airport scanners, making it very easy to smuggle into a country.

Who will exhume the body, and what will they do?
Arafat's widow Suha Arafat requested his exhumation from his mausoleum in Ramallah, to which the Palestinian Authority has agreed. Swiss, French and Russian scientists will take samples from Arafat's bones, says Tawfik Tirawi, who heads the Swiss-Palestinian team investigating the death alongside the French investigation. Arafat will then be reburied the same day.

Can they really detect a deadly dose after all this time?
Polonium-210 has a half-life of 138 days, meaning the radioactivity of a sample drops by half during that period. Arafat died more than eight years ago, equivalent to around 22 half-lives. That means just one part in 2.5 million of the original source would remain, says Regan. "That sounds tiny, but if he had enough in him to kill him, it is very measurable," he says. "If there is a significant amount above background in his bones, that would be pretty convincing."

Where would any purported assassins get polonium-210 from?
The main source is a specific type of Russian nuclear facility called a molten bismuth-cooled reactor. However, tracing the exact origin of any polonium-210 found in Arafat's bones would be very difficult, says Regan ? that is where the science ends and police work begins.

So if they find it in Arafat's bones, does that definitely mean he was murdered?
If investigators find elevated levels of polonium-210 similar to those found on Arafat's clothes, it would point to poisoning as a likely cause of death. "If he came into contact with polonium, it is likely to have been an attempt at poisoning," says Roger Jewsbury, a chemist at the University of Huddersfield, UK. On the other hand, low levels of polonium-210 exist in nature, so the presence of only trace amounts would seem to rule out foul play.

The results can be further corroborated by looking for accompanying natural radiation sources such as lead-210, lead-214 or bismuth-214, which are part of the natural polonium-210 decay chain and so would not be present if Arafat had been poisoned. Tirawi did not specify when results would be announced, but he says it could take months.

Small Business Saturday Gives Black-Owned Stores A Boost, But ...

Every Saturday is Small Business Saturday for Oyin Handmade owner Jamyla Bennu. Her 3-year-old shop in the budding Charles Village neighborhood of Baltimore has welcomed customers only one day a week since she opened its doors in February 2009. But there is one particular date, she said, that really bolsters sales -- the Saturday right after Thanksgiving.

"It drives traffic both to our Internet business and to our brick-and-mortar business," Bennu told The Huffington Post, referring to American Express' annual Small Business Saturday initiative, now in its third year. "We get lots of people through social media ... [who] may have waited for the sale to try [our products] for the first time even if they had heard about it before and had been interested," Bennu said. "That discount or sale may be the thing that's pushed them over the edge."

Melinda Emerson also plans to use Small Business Saturday to build her client list.

Emerson, an entrepreneur expert, said she is discounting her latest ebook, How to Become a Social Media Ninja, this weekend. "If you buy something from me for $10, next time you'll probably spend $50, so it's more valuable to me to discount my hottest product right now," she said.

Bennu and Emerson are not alone in looking to capitalize on Small Business Saturday's success. An estimated 103 million Americans shopped at small businesses on the Saturday after Thanksgiving last year, with merchants reporting a 23 percent increase in card-member transactions that day.

Yet Bennu and Emerson are still unusual. Although African-Americans together wield a trillion-dollar spending power, retail isn't a sector where black entrepreneurs are cashing in.

"A lot of our successful businesses aren't retailers," said Harry Alford, president of the National Black Chamber of Commerce. "They're architects, engineers, IT [specialists], accountants, so [Small Business Saturday] may not really apply to how they do business," he added.

Maggie Anderson, who wrote the book Our Black Year chronicling her family's attempt to shop only at black-owned businesses for 365 days, said that black entrepreneurs have trouble in the retail sector. She blames that difficulty on a lack of access to capital, mentors and networks, and on the "sometimes arbitrary and latent racism" that keeps many businesses from even getting off the ground.

"Black business owners have to do what any other business owner has to do in order to succeed," Anderson told HuffPost Black Voices earlier this year. "The difference is that it is harder for a black business owner even when they do exactly what any other entrepreneur does," she said.

In their 2008 book Race and Entrepreneurial Success, economists Robert W. Fairlie and Alicia M. Robb made a similar point. Conducting in-depth research on why businesses owned by Asian-American entrepreneurs tend to be more successful than those owned by white and black entrepreneurs, Fairlie and Robb found that a high level of startup capital was the most important factor in the Asian business success while too little startup capital contributed to black businesses' relative lack of success. Asian business owners were also boosted by their higher levels of educational attainment relative to both white and black business owners, while white self-employed workers benefited from more opportunity to acquire work experience through a family business than their black counterparts had.

Despite Fairlie and Robb's findings, the U.S. Census Bureau reported that black entrepreneurship is on the rise, with the number of black-owned businesses in the U.S. increasing by 60.5 percent between 2002 and 2007, according to the most recent data from the bureau's Survey of Business Owners. During that period, the retail trade accounted for 15 percent of black-owned business revenue, the report said. Yet during the same period, black-owned businesses generated only 0.5 percent of the total receipts of all nonfarm businesses in the United States.

"According to the U.S. Census Bureau, black business is the fastest growing piece of American business," Alford said. But "despite the demographics that show [an increase], many of us are sole proprietors [and] have one or two employees at best," he added.

Faced with her own lack of startup capital, Bennu turned to the Internet to launch her hair and body care business. "We were in business online before we opened our brick and mortar, and I think that the much lower entry cost in opening an online business was instrumental for us in being able to get started period," she said. "If we had had to rent a kitchen and hire people in order to get started ... we wouldn't have been able to afford it."

Philadelphia business owner Joel Morgan believes that it's important for startups to mix 21st century social media savvy with traditional, in-house customer service. "I was initially concerned about getting the money ... but before I started the business, I talked to people in [the small-business community] and they were more focused on customer service than anything else. That was a surprise to me," Morgan said.

Just six months into his own entrepreneurial endeavor, a body sculpting and chiropractic business called Philly Lipo Laser, which he operates with his brother and mother, Morgan plans to take advantage of Small Business Saturday.

"We are a local business, but we're heavily reliant on the Internet," he said. "We've done the majority of our business on social media with Groupon and Living Social," he added.

Morgan cleared the initial capital hurdle by borrowing from family and savings. When that option falls short, this year's Jumpstart Our Business Startups (JOBS) Act may offer some help.

"The most important thing is that it's really cleared the way for crowd-funding," Emerson said, highlighting the provision that allows startups to gather in small investments from many individuals without making an initial public offering.

"One of the things that I have been struggling with is that everyone in the small-business community thinks that all the super smart people that deserve venture capital and angel investment live in Silicon Valley," Emerson said. "I'm really glad to know that anybody with a good idea ... a good enough story ... a compelling enough video can get funding. The crowd-funding platforms are going to do wonders and help small-business owners that otherwise would have no way to raise some capital."

Facebook proposes to end voting on privacy issues

(AP) ? Facebook is proposing to end its practice of letting users vote on changes to its privacy policies, though it will continue to let users comment on proposed updates.

The world's biggest social media company said in a blog post Wednesday that its voting mechanism, which is triggered only if enough people comment on proposed changes, has become a system that emphasizes quantity of responses over quality of discussion. Users tend to leave one or two-word comments objecting to changes instead of more in-depth responses.

Facebook said it will continue to inform users of "significant changes" to its privacy policy, called its data use policy, and to its statement of user rights and responsibilities. The company will keep its seven-day comment period and take users' feedback into consideration.

"We will also provide additional notification mechanisms, including email, for informing you of those changes," wrote Elliot Schrage, Facebook's vice president of communications, public policy and marketing, in the post.

Facebook began letting users vote on privacy changes in 2009. Since then, it has gone public and its user base has ballooned from around 200 million to more than 1 billion. As part of the 2009 policy, users' votes only count if more than 30 percent of all Facebook's active users partake. That did not happen during either of the two times users voted and it's unlikely that it will now, given that more than 300 million people would have to participate.

Jules Polonetsky, director of the Future of Privacy Forum, an industry-backed think tank in Washington, said the voting process was a "noble experiment" that didn't lead to informed debate.

Facebook said in June that it was reviewing how to get the best feedback from users on its policies.

Facebook is also proposing changes to its data use policy, such as making it clear that when users hide a post or photo from their profile page, the "timeline," those posts are not truly hidden and can be visible elsewhere, including on another person's page.

Polonetsky called Facebook's data use policy "kind of a good handbook" and a "reasonable read" on how to navigate the site's complex settings.

But most people don't read the privacy policies of websites they frequent, even Facebook's.

"I certainly recommend that people read it, but most users just want to poke someone and like someone and look at a picture," Polonetsky said.
